1. Definitions

The data protection declaration of SENTIDE GmbH is based on the terms used by the European legislator for the adoption of the General Data Protection Regulation (GDPR). Our data protection declaration should be easily legible and understandable for the public as well as for our customers and business partners. To ensure this, we would like to explain the terms used in advance.

In this privacy policy we use, among others, the following terms:

  • Personal data: Personal data is all information relating to an identified or identifiable natural person (hereinafter "data subject"). A natural person is considered identifiable if he or she can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more special characteristics that express the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  • Affected person: Data subject is any identified or identifiable natural person whose personal data is processed by the controller.
  • processing: Processing is any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
  • Restriction of processing: Restriction of processing is the marking of stored personal data with the aim of limiting its future processing.
  • Profiling: Profiling is any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.
  • Pseudonymization: Pseudonymisation is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.
  • Controller or person responsible for processing: Controller or person responsible for processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, decides on the purposes and means of processing personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for his or her nomination may be provided for by Union or Member State law.
  • Processor: Processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
  • Recipient: Recipient is a natural or legal person, public authority, agency or other body to which personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular investigation in accordance with Union or Member State law shall not be considered recipients.
  • ThirdThird party: A third party is a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons authorised to process personal data under the direct responsibility of the controller or processor.
  • consentConsent is any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data concerning him or her.

4. General information on data processing


4.1. Scope of processing of personal data

We generally only process our users' personal data to the extent that this is necessary to provide a functional website and our content and services. Our users' personal data is generally only processed with the user's consent. An exception applies in cases where prior consent cannot be obtained for actual reasons and the processing of the data is permitted by law.

4.2. Legal basis for the processing of personal data

If we obtain consent from the data subject for processing personal data, Art. 6 (1) (a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis.


When processing personal data that is necessary to fulfill a contract to which the data subject is a party, Art. 6 (1) (b) GDPR serves as the legal basis. This also applies to processing operations that are necessary to carry out pre-contractual measures.


If the processing of personal data is necessary to fulfill a legal obligation to which our company is subject, Art. 6 (1) (c) GDPR serves as the legal basis.


In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 (1) (d) GDPR serves as the legal basis.


If processing is necessary to protect a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not outweigh the former interest, Art. 6 (1) (f) GDPR serves as the legal basis for processing.

4.3. Data deletion and storage period

The personal data of the data subject will be deleted or blocked as soon as the purpose for which they were stored no longer applies. Data may also be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. Data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need to continue storing the data for the conclusion or fulfillment of a contract.



5. Legal or contractual provisions for the provision of personal data; necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of non-provision

We would like to inform you that the provision of personal data is sometimes required by law (e.g. tax regulations) or may also arise from contractual provisions (e.g. information on the contractual partner). Sometimes it may be necessary for a data subject to provide us with personal data in order to conclude a contract, which we must subsequently process. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with him or her. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before the data subject provides personal data, the data subject must contact our data protection officer. Our data protection officer will inform the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and what the consequences of not providing the personal data would be.



6. Provision of the website and creation of log files


6.1. Description and scope of data processing

The website of SENTIDE GmbH collects a series of general data and information each time the website is accessed by a data subject or an automated system. This general data and information is stored in the server's log files. The following can be collected:


  1. browser types and versions used,
  2. the operating system used by the accessing system,
  3. the website from which an accessing system reaches our website (so-called referrer),
  4. the sub-websites that are accessed via an accessing system on our website,
  5. the date and time of access to the website,
  6. an Internet Protocol address (IP address),
  7. the Internet service provider of the accessing system and
  8. other similar data and information used to avert dangers in the event of attacks on our information technology systems.


When using this general data and information, Intenta GmbH does not draw any conclusions about the person concerned. Rather, this information is needed to


  • to deliver the contents of our website correctly,
  • to optimise the content of our website and the advertising for it,
  • to ensure the long-term functionality of our information technology systems and the technology of our website, and
  • to provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack.


These anonymously collected data and information are therefore evaluated by Intenta both statistically and with the aim of increasing data protection and data security in our company in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.


The log files contain IP addresses or other data that allow an assignment to a user. This could be the case, for example, if the link to the website from which the user accesses the website or the link to the website to which the user switches contains personal data.


The data is also stored in the log files of our system. This data is not stored together with other personal data of the user.

6.2. Legal basis for data processing

The legal basis for the temporary storage of data and log files is Art. 6 (1) (f) GDPR.

6.3. Purpose of data processing

The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user's computer. For this purpose, the user's IP address must be stored for the duration of the session.


The data is stored in log files to ensure the functionality of the website. We also use the data to optimize the website and to ensure the security of our information technology systems. The data is not evaluated for marketing purposes in this context.


Our legitimate interest in data processing pursuant to Art. 6 (1) (f) GDPR also lies in these purposes.

6.4. Duration of storage

The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. If the data is collected to provide the website, this is the case when the respective session has ended.


If the data is stored in log files, this is the case after seven days at the latest. Storage beyond this period is possible. In this case, the users' IP addresses are deleted or altered so that it is no longer possible to assign the calling client.

6.5. Possibility of objection and removal

The collection of data to provide the website and the storage of data in log files is essential for the operation of the website. Consequently, the user has no option to object.



7. Use of cookies


7.1. Description and scope of data processing

In order to make visiting our website more attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your device. Some of the cookies we use are deleted at the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your device and enable us to recognize your browser the next time you visit (persistent cookies). You can set your browser so that you are informed when cookies are set and decide individually whether to accept them or to exclude the acceptance of cookies in certain cases or in general. If you do not accept cookies, the functionality of our website may be restricted.


Some elements of our website require that the accessing browser can be identified even after a page change.

7.2. Legal basis for data processing

The legal basis for the processing of personal data using cookies is Art. 6 (1) (f) GDPR.

7.3. Purpose of data processing

The purpose of using technically necessary cookies is to simplify the use of websites for users. Some functions of our website cannot be offered without the use of cookies. For these, it is necessary that the browser is recognized even after changing pages.


We need cookies for the following applications:

  • Remembering search terms


The user data collected through technically necessary cookies are not used to create user profiles.


The analysis cookies are used to improve the quality of our website and its content. The analysis cookies tell us how the website is used and enable us to continually optimize our offering.


Our legitimate interest in processing personal data for these purposes also lies in accordance with Art. 6 (1) (f) GDPR.

7.4. Duration of storage, possibility of objection and removal

Cookies are stored on the user's computer and transmitted from there to our site. Therefore, as a user, you have full control over the use of cookies. You can deactivate or restrict the transmission of cookies by changing the settings in your Internet browser. Cookies that have already been stored can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may no longer be possible to fully use all of the website's functions.



8. Contact form and email contact


8.1. Description and scope of data processing

Due to legal regulations, the website of SENTIDE GmbH contains information that enables quick electronic contact with our company and direct communication with us, which also includes a general address for so-called electronic mail (email address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the controller are stored for the purposes of processing or contacting the data subject. This personal data is not passed on to third parties.


If you use our contact form, the following data entered in the input mask will be transmitted to us and stored:


  • First name

8.2. Legal basis for data processing

The legal basis for the processing of data is Art. 6 (1) (a) GDPR if the user has given their consent.


The legal basis for the processing of data transmitted when sending an email is Art. 6 (1) (f) GDPR. If the email contact is aimed at concluding a contract, the additional legal basis for processing is Art. 6 (1) (b) GDPR.

8.3. Purpose of data processing

The processing of personal data from the input mask serves us solely to process the contact. In the case of contact by email, this also constitutes the necessary legitimate interest in processing the data.


All other personal data processed during the sending process serve to prevent misuse of the contact form and to ensure the security of our information technology systems.

8.4. Duration of storage

The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. For the personal data from the input mask of the contact form and those that were sent by email, this is the case when the respective conversation with the user has ended. The conversation is ended when it can be inferred from the circumstances that the matter in question has been conclusively clarified.


The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.

8.5. Updating/deleting your personal data

You have the opportunity to review, change or delete the personal information you have provided to us at any time by sending us an email.


You also have the right to revoke any consent you have given at any time with future effect.


The stored personal data will be deleted if you revoke your consent to storage.


The controller shall process and store personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject.


If the storage purpose no longer applies, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.


9. Web analysis by Google (Universal) Analytics

This website uses Google (Universal) Analytics, a web analysis service provided by Google Inc. (www.google.de). Google (Universal) Analytics uses methods that enable an analysis of your use of the website, such as so-called "cookies", text files that are stored on your computer. The information generated about your use of this website is usually transferred to a Google server in the USA and stored there.


By activating IP anonymization on this website, the IP address is shortened before transmission within the member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The anonymized IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

9.1. Legal basis for the processing of personal data

The legal basis for the processing of users’ personal data is Art. 6 (1) (f) GDPR.

9.2. Purpose of data processing

The processing of users' personal data enables us to analyse the surfing behaviour of our users. By evaluating the data obtained, we are able to compile information about the use of the individual components of our website. This helps us to continuously improve our website and its user-friendliness. For these purposes, we also have a legitimate interest in processing the data in accordance with Art. 6 (1) (f) GDPR. By anonymising the IP address, the user's interest in the protection of their personal data is sufficiently taken into account.

9.3. Duration of storage

The data will be deleted as soon as it is no longer required for our recording purposes.

9.4. Possibility of objection and removal

Cookies are stored on the user's computer and transmitted from there to our site. Therefore, as a user, you have full control over the use of cookies. You can deactivate or restrict the transmission of cookies by changing the settings in your Internet browser. Cookies that have already been stored can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may no longer be possible to fully use all of the website's functions.

9.5. Embedded videos from external websites

Some of our pages contain embedded content from YouTube. When you simply access a page from our website with embedded videos from a YouTube channel, no personal data is transmitted, with the exception of the IP address. In the case of YouTube, the IP address is transmitted to Google Inc., 600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").



10. Rights of the data subject

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller:

10.1. Right to information

You can request confirmation from the controller as to whether personal data concerning you are being processed by us.


If such processing takes place, you can request the following information from the controller:


  • the purposes for which the personal data are processed;
  • the categories of personal data being processed;
  • the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed;
  • the planned duration for which the personal data concerning you will be stored or, if specific information is not possible, the criteria used to determine that period;
  • the existence of a right to rectification or erasure of personal data concerning you, a right to restriction of processing by the controller or a right to object to such processing;
  • the existence of a right to lodge a complaint with a supervisory authority;
  • available information about the origin of the data if the personal data are not collected from the data subject;
  • the existence of automated decision-making, including profiling, referred to in Article 22 (1) and (4) of the GDPR and – at least in those cases – meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject.


You have the right to request information as to whether the personal data concerning you will be transferred to a third country or to an international organization. In this context, you can request to be informed of the appropriate guarantees in accordance with Art. 46 GDPR in connection with the transfer.

10.2. Right to rectification/updating

You have the right to request rectification and/or completion from the controller if the personal data concerning you that are processed are incorrect or incomplete. The controller must carry out the rectification immediately.

10.3. Right to restriction of processing

You can request the restriction of the processing of personal data concerning you under the following conditions:


  • if you contest the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data;
  • the processing is unlawful and you oppose the erasure of the personal data and request the restriction of the use of the personal data instead;
  • the controller no longer needs the personal data for the purposes of processing, but you require them to assert, exercise or defend legal claims, or
  • if you have objected to processing pursuant to Art. 21 Para. 1 GDPR and it has not yet been determined whether the legitimate reasons of the controller outweigh your reasons.


If the processing of personal data concerning you has been restricted, these data may – with the exception of storage – only be processed with your consent or for the establishment, exercise or defence of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

10.4. Right to erasure


10.4.1. Obligation to delete

You may request that the controller delete the personal data concerning you immediately and the controller is obliged to delete this data immediately if one of the following reasons applies:


  • The personal data concerning you are no longer necessary for the purposes for which they were collected or otherwise processed.
  • You withdraw your consent on which the processing is based according to Art. 6 Para. 1 lit. a or Art. 9 Para. 2 lit. a GDPR, and there is no other legal basis for the processing.
  • You object to the processing pursuant to Art. 21 Para. 1 GDPR and there are no overriding legitimate reasons for the processing, or you object to the processing pursuant to Art. 21 Para. 2 GDPR.
  • The personal data concerning you have been processed unlawfully.
  • The erasure of personal data concerning you is necessary to fulfil a legal obligation under Union or Member State law to which the controller is subject.
  • The personal data concerning you were collected in relation to information society services offered in accordance with Art. 8 (1) GDPR.
10.4.2. Information to third parties

If the controller has made the personal data concerning you public and is obliged to erase them pursuant to Art. 17 Para. 1 GDPR, the controller shall take appropriate measures, including technical ones, taking into account the available technology and the implementation costs, to inform data controllers which process the personal data that you, as the data subject, have requested the erasure by them of all links to these personal data or of copies or replications of these personal data.

10.4.3. Exceptions

The right to erasure does not exist if processing is necessary


  • to exercise the right to freedom of expression and information;
  • to fulfill a legal obligation required by Union or Member State law to which the controller is subject or to perform a task carried out in the public interest or in the exercise of official authority vested in the controller;
  • for reasons of public interest in the area of public health pursuant to Art. 9 (2)(h) and (i) and Art. 9 (3) GDPR;
  • for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes pursuant to Art. 89 (1) GDPR, insofar as the right referred to in section a) is likely to render the achievement of the objectives of this processing impossible or seriously compromises it, or
  • to assert, exercise or defend legal claims.

10.5. Right to information

If you have asserted your right to rectification, erasure or restriction of processing vis-à-vis the responsible party, this party is obliged to inform all recipients to whom the personal data concerning you were disclosed of said rectification, erasure or restriction of processing, unless doing so should prove impossible or involve disproportionate expenditure.

You have the right to be informed by the controller about these recipients.

10.6. Right to data portability

You have the right to receive the personal data concerning you that you have made available to the controller in a structured, common and machine-readable format. In addition, you have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was made available, provided that


  • the processing is based on consent in accordance with Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR or on a contract in accordance with Art. 6 (1) (b) GDPR and
  • the processing is carried out using automated procedures.


In exercising this right, you also have the right to have the personal data concerning you transmitted directly from one controller to another, where technically feasible. This must not affect the freedoms and rights of other persons.


The right to data portability does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

10.7. Right of objection

You have the right to object at any time to the processing of personal data concerning you which is carried out on the basis of Art. 6 (1) (e) or (f) GDPR, for reasons related to your particular situation; this also applies to profiling based on these provisions.


The controller will no longer process the personal data concerning you unless he can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or unless the processing serves to assert, exercise or defend legal claims.


If the personal data concerning you is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for the purposes of such advertising; this also applies to profiling insofar as it is related to such direct marketing.


If you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.


In connection with the use of information society services, you have the option of exercising your right of objection by means of automated procedures that use technical specifications, notwithstanding Directive 2002/58/EC.

10.8. Right to revoke the declaration of consent under data protection law

You have the right to revoke your consent to data protection at any time. The revocation of the consent does not affect the legality of the processing carried out on the basis of the consent until the revocation.

10.9. Automated decision-making in individual cases, including profiling

You have the right not to be subjected to a decision based solely on automated processing – including profiling – which produces legal effects concerning you or similarly significantly affects you. This shall not apply if the decision


1) is necessary for the conclusion or performance of a contract between you and the controller,
2) is permitted by Union or Member State law to which the controller is subject and which contains appropriate measures to safeguard your rights and freedoms as well as your legitimate interests, or
3) with your express consent.


However, these decisions must not be based on special categories of personal data pursuant to Art. 9 (1) GDPR, unless Art. 9 (2)(a) or (g) GDPR applies and appropriate measures to protect your rights and freedoms as well as your legitimate interests have been taken.


In the cases referred to in points 1) and 3), the controller shall implement suitable measures to safeguard your rights and freedoms and your legitimate interests, including at least the right to obtain human intervention on the part of the controller, to express your point of view and to contest the decision.

10.10. Right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, place of work or place of the alleged infringement if you consider that the processing of personal data concerning you infringes the GDPR.


The supervisory authority with which the complaint was submitted shall inform the complainant of the status and outcome of the complaint, including the possibility of a judicial remedy under Art. 78 GDPR.


11. General legal basis for processing

Unless otherwise stated, Art. 6 (1) (a) GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary to fulfill a contract to which the data subject is a party, as is the case, for example, with processing operations necessary for the delivery of goods or the provision of other services or consideration, the processing is based on Art. 6 (1) (b) GDPR. The same applies to processing operations that are necessary to carry out pre-contractual measures, for example in cases of enquiries about our products or services. If our company is subject to a legal obligation which requires the processing of personal data, such as to fulfill tax obligations, the processing is based on Art. 6 (1) (c) GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information had to be passed on to a doctor, hospital or other third parties. In that case, the processing would be based on Art. 6 (1) (d) GDPR. Ultimately, processing operations could be based on Art. 6 (1) (f) GDPR. This legal basis is used for processing operations that are not covered by any of the aforementioned legal bases if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not prevail. We are permitted to carry out such processing operations in particular because they were specifically mentioned by the European legislator. In this respect, it took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47, Sentence 2 GDPR).



12. Collection and use of personal data in the application process

It is important to SENTIDE GmbH to ensure the highest possible level of protection for your personal data. All personal data that we collect and process as part of an application is protected against unauthorized access and manipulation by technical and organizational measures.
